Real Estate Images & Video Terms, Conditions, and Copyright

License for photos of a single real estate listing on the Multiple Listing Service (MLS) (one MLS number per license). 

By using the images and video, you agree to the following:

Pro MLS Photos (dba of Mylu LLC) hereby grants you a non-exclusive, world-wide, non-transferable, non-assignable, limited license to use the downloaded images for a single listing, including any and all advertising (including, but not limited to, print or electronic media and syndication on various other sites) for the purpose of selling the listing. These rights expire upon completion of the sale of the listing or upon removal from the market. A new Multiple Listing Service number requires a new agreement for the use of the images and/or video.

Pro MLS Photos explicitly retains all copyrights to the images and video as well as moral rights to each image. Pro MLS Photos also retains all rights not expressed in the agreement including advertising rights.

No photo credit/acknowledgement of the images or video is required while using them for the purpose to sell a real estate listing.

Selling and/or redistribution of the images and/or video is forbidden.

Licensee is allowed to crop and/or electronically alter the image to suit their purposes for the usage stated above. This includes any derivatives of the image that may be made.

Payment in full for the license is required prior to the use of the images. Any use of the image prior to payment will be considered an infringement under the United States Copyright Law and Pro MLS Photos has the ability to terminate contract and file a claim in Federal Court.

Jurisdiction for all claims rests in either King County District Court, King County Superior Court, or the United States District Court for the Western District of Washington.

If one or more of the provisions contacted in this agreement is found to be invalid, illegal, or unenforceable in any aspect, the validity, legality, and enforceability of the remaining provisions shall not be affected.
